If someone is repeatedly kicking in your fence (asked on behalf of a friend, although fence doubly reinforced now so should not be a problem anymore) are you free to take photographic evidence of the individuals without being able to be held liable for any wrong doing?

Donna as far as the chubs understands it as long as your photographs are not of an indecent nature you are free to take photo's of whatever and whoever you like. The only law that may cover it is protection from harassment if you are constantly following the same person around etc. As a private person you cannot breach someones human rights, only official government bodies like police, council etc can do that. I found all this out from camera club and my brief for my brother Denny who still lives down pompey, he was doing candid shots of birds bending over and that in their lunchbreaks in the park and someone called the old bill. They had a quick look at what he was doing but he weren't committing no offences so they left. He got some good pics too!

correct, although they wouldn't accuse the chubs of that more than once if you get my drifter? I had this at a kids footy match down pompey when I went to take some snaps. some bleedin pillock reckoned it was against the law to take snaps. he soon scampered of though once we had a brief chat.

It seems to be an urban myth that you can't photograph children.The offence is possessing indecent images of children. If you photograph a child committing a criminal offence and the image isn't indecent there is no problem.
Inevitably the parent of the offending child will phone the police and say something along the lines "Some bloke/woman is taking pictures of my kid". They will fail to mention that the little poop was actually causing damage to a neighbours fence. So it's possible you will get a visit from the police, but as soon as you explain the circumstances that will be the end of it. You can then hand over the evidence so the kid can be dealt with.

I would agree, there seems to be a lot of misinformation about what you can/ cant do with regards to to CCTV or Photographic evidence. I am unaware of any law that would preclude you from protecting your property in this manner, be it mounting CCTV on your house or taking photos of suspected offenders, the only caveat being that you will be delighted to hear that there are extremely stringent laws restricting Public Bodies from collating such evidence which might result in capturing what could be deemed as Private information.

I made brief enquiries when I deployed CCTV at another address and was told by the local authority that there are different rules if it is a business or a private home using CCTV. Business CCTV's have very stringent rules as to what is and what is not allowed.
From what I could gather a private home occupier can stick up all the cameras they want and even point them to cover neighbouring properties. The only proviso is that a camera must not intrude inside anyones home. I.e. the field of view must be below anyones window ledge height.
(Still can't find a reasonably priced USB outdoor camera so using a webcam which looks silly but it seems to be keeping the oiks at bay)

i think that you will also find that you should display a warning sign that CCTV is in operation. Also, a validated date time stamp must also be used on any recording, that may be used in evidence in a court of law. Most cameras come with a log, so that a record of when the displayed date time was set and checked

There is no requisite to display a sign in a private dwelling but it certainly makes an Oik think twice. I downloaded mine from the net for free. The programme I'm using (Pryme) is FREE, extremely nice, time/date stamps the picture and offers stop frame or continuous recording with audio. It also has an adjustable movement detector which works on a bog standard camera. I've stuck an extra 40 Gig hard drive in the pc and dedicated it to the CCTV system. As I say, just got to find a proper USB outdoor camera now so I can have my web cam back. http://www.hilo.dk/pryme.php

 have to agree with that one as well dorian.... and if u wait and watch.. you will see more often than not its a culprit from the estate agents....take your pic !!! it makes me mad as well....my nan cant walk far ..even on my arm adn that extra bot farther means the differance as to wether she can then make it around coopers if i cant park in the high street near to the building society ..fruit n veg shop and pet shop... makes my blood boil when you see people coming out of the cake shop of dry cleaners with clothes and jump into posh cars parked in the disabled bays... And while im at it.... the amouont of workers from the s hops in the high street who park in the actual high streeet taking up spaces is ridiculous... AGAIIN its the estate agents, mens shop, cake shop and cafe owners/workers...... spend some time just looking and u will see..... i do when i have my grand babies and go to town...sit n have a drink and watch the world go by on the seat..and its amazing what you see

I think the whole disabled badge scheme needs to be looked at. I feel sometimes that it is abused and that many people with a badge don't really need one. I have a friend who has a badge because his mother is disabled, but he uses it when he goes out without his mum.
I've seen some so called disabled people park up and walk off without any sign of a disability. It spoils it for the genuine cases.
